The definition of small entity changed on January 1, 2024 to include entities with fewer than 100 employees, rather than 50 or fewer employees under the old rules.  Applicants who were previously considered standard entities under the old rules and qualify as a small entity under the new rules, with fewer than 100 employees as of the filing date of the application, would be permitted to change entity status to small through submission of an executed small entity declaration.  Once the application changes to a small entity basis, all future fees may be paid at the small entity rate; however, the Patent Office will not refund past fees paid as a standard entity.  If you believe that this application, or any other application we are handling for you, might qualify for such a change in entity status, please let us know.
